Ask The Michigan Firearm Instructor: Defending Strangers With Lethal Force

Q: Rick, I have a question. As a CPL holder, do I have the capacity to defend others (strangers) that I see that are in imminent danger? Or being hurt by others???

A: The short answer is Yes. However, I believe that it would be wise for one to carefully explore under exactly which circumstances - before it happens - when he will intervene with lethal force.

First, lets take a quick look at the applicable Michigan statute - MCL 780.972. It states in its entirety the following:

Sec. 2.

(1) An individual who has not or is not engaged in the commission of a crime at the time he or she uses deadly force may use deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if either of the following applies:

(a) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent death of or imminent great bodily harm to himself or herself or to another individual.

(b) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent sexual assault of himself or herself or of another individual.

(2) An individual who has not or is not engaged in the commission of a crime at the time he or she uses force other than deadly force may use force other than deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if he or she honestly and reasonably believes that the use of that force is necessary to defend himself or herself or another individual from the imminent unlawful use of force by another individual.

So, as you can plainly see, you could come to the aid of another person as long as you have a right to be where you are located, you are not committing a crime, and that other person is facing imminent sexual assault, imminent great bodily harm, or imminent death.

There are risks associated with defending another person. Be sure that you are certain of the circumstances. Coming to the aid of a stranger can get you in you big trouble if the "victim" does not corroborate your story. Imagine that one day, for example, you see a man viciously beating his significant other in public. If you intervened with lethal force - kill her abusive boyfriend or husband - will she be thankful or vengeful when the smoke clears and the police arrive? After all, you just killed her lover.

As a rule, I urge caution when one is considering getting involved in the affairs of others - especially when you do not have a perfect picture of the event unfolding before your very eyes. In contrast, if you and a friend or other person - whom you know very well - is attacked by a stranger in your presence then you are definitely clear as to what is happening.

Unless, you know the people involved I would urge caution. Maybe there is another option that does not immediately involve you using lethal force on the behalf of a stranger. Of course, the choice is yours. Whatever you decide, I hope that you make the right decision. If all else fails, you could call 9-1-1 and be a great witness.

Rick Ector Was Featured In Detroit News Story on Surge in Michigan CPL Class Registrations

This past Saturday - January 23rd, 2016 - the Detroit News published a story on the surge in interest of CPL Classes in metro-Detroit.

The photos were actually taken from a live class that was conducted earlier in the month - Saturday, January 9th, 2016.

Eight of the sixteen pictures published in the newspaper featured "Legally Armed In Detroit" Firearm Trainer - Rick Ector.

All of the published pictures featuring Rick Ector demonstrated an important facet of fundamental firearm safety.


I was informed by the photographer that there was going to be a delay in the publication of the story due to all of the expected media attention that was going to be devoted to the North American International Auto Show (NAIAS) that had just opened at Cobo Hall in downtown Detroit.

Q: Hey Rick, I just have a question that I hope you can shed some light on. I was at the gun shop the other day and the guy behind the counter told me that there are actually restrictions on the type of self defense cartridges a person with a cpl can use. I specifically asked him about the Lehigh maximum expansion rounds that are very good for under penetration. He said those would be restricted and I would be in trouble if I ever had used those in a self defense situation. I cannot find any info online about these supposed restrictions and I was wondering if you knew any more on this. Thanks!

A: I am unaware of any prohibitions against using any "off-the-shelf" ammunition cartridges for users who have no firearm ownership and gun possession disabilities in the state of Michigan. I am fully apprised of the fact that civilian operators in the state of New Jersey can't own or possess jacketed hollow point (JHP) ammunition.

For the record, I strongly endorse that operators - where legal - only use "defensive" ammunition for personal protection. Those rounds, such as JHPs, are designed to hit, penetrate, and stop in the first struck target. This is a safety feature designed to protect innocents. Alternatively, it is very likely, especially for the 9mm caliber, that practice rounds (FMJs) will over-penetrate and will also hit whatever is located behind the intended target.

If you "accidentally" shoot an unintended target, you may be sent to prison and lose all of your worldly possessions in a civil suit. Thus, you SHOULD always use defensive rounds for personal protection. You will pay more money but peace of mind is worth the expenditure. Carrying practice rounds in your firearm is too risky.

Q: Rick, I am looking to purchase a new carry firearm. What are the advantages and disadvantages of a safety?

A. The sole advantage of a safety is to prevent the firearm from being intentionally discharged while it - the safety - is engaged. If you insist on buying a firearm with a safety, you must first understand that it is a mechanical device which could - in theory - fail to operate at some point in time. Thus, you might be lulled into thinking that a gun with its safety engaged will not discharge when it might.

Accordingly, you should always treat any firearm in your possession as if it is loaded AND that there is no safety present on the gun:
- Always keep it pointed in a safe direction.
- Always keep your finger off the trigger until you are ready to shoot.
- Always keep "out of use" firearms unloaded, separated, and locked.

Some people have told me, in the past, that they desire a safety to keep themselves from having a negligent discharge when drawing. My retort is that one should be comfortable with producing their firearm without touching the trigger. If one does not have that level of proficiency yet, he should get additional training and practice.

Another justification for a safety, as relayed to me, is that it will prevent an unauthorized user - such as a child - from hurting himself if he finds it unattended. No firearms should be unattended in the vicinity of unauthorized users - period. Children are smarter than we sometimes give them credit. Given enough time, the safety can be disengaged and become operational. There are far better ways to safeguard children from unattended firearms: education, training, and locks.

Additionally, firearms with safeties will require additional training for the operator. The user needs to practice disengaging the safety before shooting. If the act of disengaging the safety has not become "instinctive" behavior, the operator may forget to disengage the safety when defending himself against a person who is attempting to rob, rape, or kill him. 

In my opinion, the best "safety" is the knowledge and application of fundamental firearm safety each and every single time one comes into contact with a firearm. Personally, none of my carry firearms have a safety. However, that is my personal preference and it should NOT be the sole determinant as to whether a safety on a firearm is right for you. You will need to make that decision for yourself.

Mental Illness, Guns, and Background Checks


A very interesting story was aired last night on Fox 2 News. It featured a story about a woman - Jannette Williams - who was reported as having battled several mental illnesses over the past 30 years. Among the diagnoses she has received were Manic Depression, Bi-Polar Disorder, and Schizophrenia. 

The most shocking revelation of the story was the allegation that she was allowed to buy a handgun - a .25 caliber "automatic" - in 1983 which was eventually stolen and that she was also later approved in 2011 to buy another pistol that she did not pursue. Williams, presumably, came forward and went public to the media in an effort to share her story and demonstrate that she should not have been authorized to buy a handgun. She claims that she even wrote to President Obama in the past to encourage him to continue calling for more gun control because people like her should not be able to buy a gun.

In an era in which the current POTUS has steadily called for more gun control - despite his lame duck status, a dearth of needed votes on Capitol Hill, and a vote of no confidence from the American public on terrorism - the local media was only too happy to push the story. The obvious elephant in the room: How was she legally cleared to buy a handgun?

Presumably, she does not have a Michigan Concealed Pistol License (CPL) because one was not mentioned or shown, while a yellow Michigan Pistol Purchase Permit was proudly displayed, and that Williams mentioned getting her approval from the intersection of the "Boulevard and Woodward." 

Under current Michigan law, persons without a CPL but who wish to buy a handgun can have a background check performed at a Federal Firearm Licensee (FFL) - also known as a gun shop - and buy it directly or can get a Purchase Permit from their local police department for a private transfer. However, back in 2011, when she alleged that she was last cleared to buy a handgun, all non CPL-holders had to get Purchase Permits from their local police agency. Accordingly, Detroit residents were all processed at the police station on the corner of Grand Blvd. and Woodward.

Thus, Williams would have had a background check performed on her at the aforementioned Detroit police precinct. Presumably, her mental illnesses were not in the system when she was checked, if her story is authentic. If she passed, she would have been given a Pistol Purchase Permit like the one she was holding on the television piece. Also, she would have needed to complete her pistol purchase transaction at any time within the next 10 days.

Since she allegedly did not follow through with a pistol purchase in 2011 - at her last alleged approval - she was required to complete some paperwork at the gun shop when she bought a pistol in 1983. Among the paperwork that she would have been required to complete is a form known as 4473. 

The Form 4473 in its current state - and in some fashion in 1983 - asks the purchaser to truthfully answer its questions under threat of perjury - a felony conviction. Among the listed questions would have been a statement to be marked "Yes/No" as to whether the purchaser "had been adjudicated as mentally defective by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs OR have you ever been committed to a mental institution?"

So, it is entirely possible that a person, such as Williams, with the illnesses that she claims to have can honestly answer the aforementioned question truthfully and still be qualified to buy a handgun. This would be the case if her diagnoses were never officially recorded or documented outside of her personal medical history with her doctor. 

So, an obvious barrier exists with respect to disclosure of medical info to determine mental fitness for a firearm purchase. That obstacle is better known as the Health Insurance Portability and Accountability Act (HIPAA) which was enacted in 1996. Among its many provisions, it requires the protection and confidential handling of protected health information.

How do we remedy the issue? Easy, a change can be made to the question asked on the Form 4473 or the HIPAA Law can be amended to allow medical records to be checked for firearm purchase eligibility. Neither of these solutions is an expansion of background checks. They are both tweaks to the current process. 

More than anything, I believe a word of caution is due here. Only a qualified mental health professional is qualified to determine whether a mental condition possessed by a patient is a genuine threat to himself or another person. Accordingly, these evaluations should not be performed by a question on a form or a query asked by a FFL.

A true expansion of background checks would be mandating checks on transfers not currently being performed. For example, in Michigan and in a number of other states, background checks are not required on private transfers of long guns - rifles and shotguns. Statistically, they are not needed. Significantly far more people are killed and far more crimes are done with just bare fists, sharp objects, and hard hand-held blunt "things" relative to long guns.

Finally, I would be remiss if I did not disclose one additional fact. Bad guys who can't pass mental health background checks are not going to acquire firearms by any channels that require them. In short, no law is going to make bad guys change their behavior. Bad guys do what bad guys do. Don't let the liberal media and smooth talking lame ducks trick you out of your rights.

UPDATE: I had an opportunity to speak with a fellow gun rights advocate from MN - Andrew Rothman - on this issue today. As a result, I agree that due process should still be afforded to the patient if a determination has been made by a mental health professional that the patient is a threat to himself or others. As such, an aforementioned diagnosis that is injurious to his gun rights should be documented and adjudicated by a court. If that determination is made in court, then and only then should the patient be reported to NICS.

I had previously heard of Nikki Goeser's story but did not take take the time to read her account in her memoir before now. My copy from Amazon was in my mailbox this morning, so that was my cue to read it.
From the very beginning, the story starts immediately with a quick run-up to the murder of her husband. Listening to her account was tough to bear but it was totally necessary to understand her mindset today as it relates to her fervent desire to advocate for gun rights.
In the aftermath, you will be given a crash-course in what it is like to lose a loved one. Many of us have not lost a spouse, so we are only left imagine on our own what it is like unless we are given a first-hand account. Nikki goes into great detail of her experience. It takes a ton of courage to open up and share that part of her life with her readers.
Later, we are informed of her work within the gun rights community and how she helped to get a Restaurant Carry Bill passed in her state of TN. Thereafter, we learn of her on the behalf of other states seeking to have their own gun laws reformed.
Finally, we get to learn of her frustrations with the criminal justice system. They say that it moves slow but steady. In the case of her husband's killer - whom she never names in the book - it took three long years for the trial to begin. I won't spoil how everything turns out. I will leave that for you to discover.
In all, I thoroughly enjoyed the book. It was a good and relatively quick read. I knocked it out in one sitting and heartily endorse it for the library of anyone interested in self-defense, personal protection, and gun rights - especially women.
