Can You Legally Shoot A Carjacker Seven Times In Self-Defense?
Can You Legally Shoot A Carjacker Seven Times In Self-Defense?
During the past week, there were a few armed citizen stories published in the local Detroit media. In each incident - a total of three - that I read, the victims all discharged a firearm to successfully defend themselves against armed predators while not being physically injured. Across the three incidents, there were seven predators. Three of them were shot. Two of those died immediately and one evaded capture.
While all of the aforementioned stories garnered a fair amount of interest, one story, in my opinion, was the source of the most questions I fielded in the aftermath. People were wondering if one of the victims went too far in the defense of her life.
This past Saturday, a Detroit woman returned home for the day and after parking her vehicle in her garage was allegedly approached by two men in her home's driveway in an announced carjacking attempt. One of the men, reportedly, produced a handgun and pointed it at her head.
In response, according to published accounts, she tossed the keys, took a few steps backwards, drew her own firearm, and proceeded to shoot one of the assailants seven times. Needless to say, he died of "lead poisoning." The other bad guy took off and is still at-large.
The number one question that I have been asked by several people was a rather simple one: Did she over-do it? My official answer is an unsatisfying one - It depends.
A key concept that I teach in my CPL Class is that a Concealed Pistol License is not a James Bond 007 License. In other words, it is not a License To Kill. A CPL is nothing more than a Michigan issued permit that allows the specified person to carry a concealed pistol.
Michigan law, however, does recognize the principle of self-defense. In general, as long as someone is in a place he has a legal right to be, is not committing a crime, and has both an honest and reasonable belief that he is facing imminent danger of great bodily harm, sexual assault, or death, he has the right to use lethal force without a duty to retreat.
A person's intent when using lethal force for lawful self-defense is not to kill his assailant. Rather, the intent of the usage of lethal force is to "Stop The Threat." When the threat to a victim's safety has ended, then the victim must accordingly stop using lethal force.
Accordingly, there is no specific number of times that a person is authorized to use lethal force. Each incident will be investigated by examining the totality of the circumstances.
Some existing variables will determine, to a certain extent, how many times lethal force needs to be used to stop the threat: caliber of firearm (if applicable), shot placement (if applicable), physical size of assailant, type of garments worn by assailant, presence of any "serious" drugs in the bloodstream of the assailant, and etc.
Furthermore, CPL-holders are taught to shoot authorized targets at its exposed "center-of-mass." This is roughly an 8.5"x11" standard sheet of paper sized area between a fully exposed target's navel and the lower part of the chest.
Even though there are a lot of key organs in this physical window which, if hit, would cause massive blood loss and shut down the target's body, the purpose of shooting at center-of-mass is not to kill. The operative concept is "Not Missing Your Target."
The intent to discharge a firearm legally travels with any bullets that leaves its barrel. If a bullet strikes, damages, or kills something or someone, the shooter will be held responsible. As such, a shooter would be well advised to only shoot targets that reasonably puts him in imminent danger of at least great bodily harm.
Center-of-mass of a target gives the shooter the best possible chance of not missing. Accordingly, fancy trick shot shooting often seen on TV shows and at the movies are ill-advised. Rather than trying to shoot off a pinky-toe or trying to ballistically shove a gun out of an assailant's hand, the victim should be shooting at the bad guy's abdomen.
A dose of reality is definitely in order. If a person is shot at center of mass with a big caliber firearm at close range, he could very well die. If a bad guy dies while a victim was lawfully defending himself while under an imminent threat of serious harm then no crime was committed - justified homicide.
So was the aforementioned Detroit woman justified in shooting her would-be attacker seven times? It depends.
In a televised report, an officer from DPD stated that she acted lawfully.

Rick Ector Appears On "Cam and Co." To Discuss Detroit Mom's Defense of Home Story
Unless you live in a cave, you have already seen the viral video of the Detroit mom who used her trusty Hi-Point Carbine Rifle to defend her home and her family from armed predators. The incident was captured on the home owner's video surveillance system and clearly shows that three invaders kicked in a door and gained entry into her residence. The story was even more incredulous when the home owner informed the bad guys that she was armed and they responded by telling her "No, you don't have a gun."
On February 19th, I was invited to make another appearance on the NRANew's "Cam and Company Show" to discuss this incident and to give my take and opinions about some of the realities of violent crime in the city of Detroit. Check out the video below and leave a comment:

As Detroit's Police Chief Advocates "Good Americans With Guns," Citizens Fight Back Against Violent Crime
Shortly after being installed as the seventh person in the last eleven years to assume the reins over the Detroit Police Department (DPD), Chief James Craig wasted little time in sharing his views about citizens legally carrying concealed pistols.
In short, he stunned the local and national media outlets with his surprising pro-gun stance and it appears - at this juncture - that local residents are apparently taking heed of his words.
DPD Chief Craig's Unconventional Stance on Guns
On December 19th of last year, Craig appeared on a local broadcast - the Paul W. Smith Show - and made the following statement, "There's a number of [Concealed Pistol License (CPL)] holders running around the city of Detroit. I think it acts as a deterrent. Good Americans with CPLs translates into crime reduction. I learned that real quick in the state of Maine."
Then a couple of weeks later at a press conference held at DPD Headquarters, Craig was quoted as saying, "If more citizens were armed, criminals would think twice about attacking them."
As a consequence of his aforementioned statements, Craig has made several national TV appearances to share his pro-carry views, which seemingly contradict those of other big city police chiefs across the country. One explanation for Craig's ability to speak out is that he does not directly report to a big city mayor, which are usually anti-gun. Detroit is currently in the midst of a bankruptcy reorganization which has Craig reporting to a state of Michigan appointed Emergency Financial Manager.
Citizens Taking Up Arms Against Attacking Predators Spikes
This past Monday night - Feb. 17th - a Detroit mom was forced to defend her family and her home against three armed intruders. The bad guys kicked in a door and rushed inside the residence, despite being told by the home owner that she was armed and was willing to defend her family. Incredulously, they responded by telling her "No, you don't" and came inside anyway. The mom discharged her Hi-Point Carbine Rifle and the invaders quickly vacated the premises.
The entire incident was captured on video and instantly went viral nation-wide. The three suspects were quickly apprehended by Detroit Police. As a consequence, DPD Chief Craig discussed the aforementioned case this past Friday on the "Nancy Grace Show" and has also been tentatively booked to speak about the aforementioned incident on "Dateline NBC." Nobody has ever accused Craig of being camera-shy.
In addition, two predators predators broke into a man's home in the wee hours of this past Saturday (Feb. 22nd) morning. In this incident, one of the bad guys attempted to strike the home owner with a tire iron. Luckily, the home owner evaded injury long enough to shoot both invaders with his firearm. One suspect died at the scene via a gun shot would to the chest. The other assailant was hit in an undisclosed location but managed to evade capture.
Further still, yet another Detroit resident was forced to defend herself with her firearm on the same day. In this incident, a woman returned home and after parking her vehicle in her garage, she was suddenly approached by two men in her driveway. One of the men produced a firearm and pointed it at her head in an apparent carjacking attempt. The victim was able to successfully draw and discharge her handgun. One of her attackers was killed at the scene and the accomplice is still at large.
Thusly, in one week in the city of Detroit there were three armed citizen defenses which resulted in three arrests, no physical injuries to victims, and the deaths of two very violent and dangerous predators. In all, it has been a great week for "Good Americans With Guns." In addition, Chief Craig will continue to beat the drum for an armed local citizenry. With any luck, more Detroit residents will heed the call and become legally armed in Detroit.
